| Americans Who Never Lived in Michigan and North Carolina Can Vote New court rulings issued on Oct. 21 say U.S. citizens who live overseas and have never resided in Michigan and North Carolina can cast ballots by mail, provided they have parents who lived in those states before leaving the country.
The Uniformed and Overseas Citizens Absentee Voting Act mandates states to accept ballots from Americans who live outside the country, while Republicans argue this requirement does not extend to citizens who have never lived in one of the states.
In Michigan, Republicans pointed out that the state constitution says citizens who are at least 21 years of age and who have resided in Michigan for six months shall be qualified to vote, yet Judge Sima Patel responded that in a 1972 ruling, the U.S. Supreme Court has found a similar residency requirement unconstitutional. Even if the Republican challenge had merit, the judge said she would still deny it because it comes too close to the November election.
